GDPR

I Basic provisions

1 The “controller” of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”) is Kateřina Fitaire, (“Controller”).
2 The contact details of the Controller are

3 ‘Personal data’ means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, an identification number, location data, network identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
4 The Controller has not designated a data protection officer.

II Sources and categories of data processed

1 The Controller processes personal data that you have provided to her or personal data that the Controller has obtained in fulfilling your order.
2 The Controller processes your identification and contact data and data necessary for performance of the Contract, i.e. mainly email addresses, and for tax purposes.
3 The Controller processes personal data provided using the contact form. The personal data provided by you in the contact form will be processed only for the purpose of enabling the Controller to contact you.

III Lawful basis and purpose of the personal data processing

1 The lawful basis for processing the personal data is
• performance of the Contract between you and the Controller pursuant to Article 6(1)(b) GDPR;
• the Controller’s legitimate interest in providing direct marketing (mainly for sending business messages and newsletters) pursuant to Article 6(1)(f) GDPR;
• your consent to the processing for the purposes of providing direct marketing (mainly for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No 480/2004 on certain information society services in cases where no goods or services have been ordered.
2 The purpose of the personal data processing is
• handling your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller; when ordering, personal data are requested insofar as they are necessary for the successful handling of the order (contact email address), the provision of personal data is a necessary requirement for concluding and fulfilling contracts and the Controller cannot conclude or perform contracts without the provision of personal data;
• sending business messages and carrying out other marketing activities.
3 The Controller will not carry out any automated individual decision-making within the meaning of Article 22 GDPR.

IV Data retention period

1 The Controller shall retain personal data
• for the time necessary for exercising the rights and obligations arising from the contractual relationship between you and the Controller and for asserting claims under these contractual relationships (for a period of 15 years from the termination of the contractual relationship);
• until the consent to the processing of personal data for marketing purposes is withdrawn, and for a maximum of 10 years, if the personal data are processed on the basis of the consent.
2 After the personal data retention period expires, the Controller shall delete the personal data.

V Recipients of personal data (subcontractors of the controller)

1 Recipients of personal data shall be persons
• involved in the provision of services or the implementation of payments on the basis of a contract;
• providing online shopping operation services and other services in connection with online shopping operations;
• providing marketing services.
2 The Controller intends to transfer personal data to a third country (a non-EU country) or an international organisation. Recipients of the personal data in third countries shall be mailing service providers.

VI Your rights

1 Under the conditions laid down in the GDPR, you have the
• right of access your personal data pursuant to Article 15 GDPR;
• right to rectify (correct) personal data pursuant to Article 16 GDPR, or to restrict processing pursuant to Article 18 GDPR;
• right to the erasure of personal data pursuant to Article 17 GDPR;
• right to object to the processing pursuant to Article 21 GDPR and
• right to data portability pursuant to Article 20 GDPR.
• right to withdraw the consent to processing in writing or electronically to the address or email of the Controller specified in Article III of these conditions.
2 You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII Personal data protection policy

1 The Controller declares that it has taken all appropriate technical and organisational measures to secure personal data.
2 The Controller has taken technical measures to secure data repositories and storage facilities for personal data in paper form.
3 The Controller declares that only persons authorised by it have access to the personal data.

VIII Final provisions

1 By submitting an order from the online order form, you confirm that you are familiar with the personal data protection policy and that you accept it in full.
2 You agree to this policy by clicking on the consent via the online form. By clicking on the consent, you confirm that you are familiar with the personal data protection policy and that you accept it in full.
3 The Controller may change this policy. The new version of this policy shall be published on the Controller’s website and at the same time the new version of this policy shall be sent to you via the email address you provided to the Controller.
This policy comes into full force and effect on 22 January 2021.
